She's 61, and will be 62 in the spring. I made a workers' disability compensation complaint for her. I also made a Social Security disability claim for her. She will ultimately qualify for that Social Security disability benefit. In the meantime, I also made an interim early Social Security retirement application for her, so she'll have some continuing income available to her while the Social Security disability and workers' disability compensation claims are pending. The lesson? See me before you go it alone, because otherwise you may make some critical mistake in electing the wrong income replacement benefit when you're in those critical (for Social Security purposes) ages between 62 (or approaching age 62) and 67.You may reach me by my law office phone at (269) 968-2215; by email at jhaadsma@mccroskeylaw.com; or stopping by my law office located at 395 South Shore Drive, Suite 308, Battle Creek, MI, 49014. The consultation is free, and I may save you many thousands of dollars now and in the future.INCOME REPLACEMENT BENEFITSA continuing dilemma many senior workers experience is what kind of Social Security disability benefit to seek when their doctor or other medical provider takes them off work.I'll briefly review two examples I've encountered within the past couple working days about what to do or not do when you suddenly can't work, and have an opportunity to seek benefits from the Social Security Administration. One man I'm helping experienced a traumatic work-related injury when he was 64. He received workers' disability compensation benefits for several months, but then the workers' disability compensation insurer stopped his workers' disability compensation benefits. This man didn't see a lawyer until almost three years later, when he was 67.I have agreed to represent this man in a workers' disability compensation case. But he's already lost more than two years of workers' disability compensation benefits because he can only recover workers' disability compensation benefits for one year before filing his workers' disability compensation complaint. But at least equally disappointing was his decision to apply for Social Security early retirement benefits with the Social Security Administration, rather than for Social Security disability benefits, even though he hasn't been able to work because of his work-related disability for the past three plus years.
